Airotica publishes written fiction created and submitted by its users. It does not produce, commission, or host photographs, video, or other visual depictions of actual or simulated sexually explicit conduct as defined in 18 U.S.C. §2256.
1. Exemption
18 U.S.C. §2257 and §2257A impose record-keeping requirements on producers of visual depictions of actual or simulated sexually explicit conduct. Airotica is not such a producer. Its content is text. Because no such depictions are produced or hosted here, no records are kept under §2257 and there is no custodian of records.
2. User-submitted content
Everything published on Airotica is submitted by its users. The operators’ activities with respect to that content are limited to its transmission, storage, retrieval, hosting, formatting, and review against the content guidelines. The only images the site accepts are author profile avatars. The guidelines prohibit nudity and sexual content in avatars, and prohibit depicting any real person other than the account holder; an avatar that breaks that rule is removed on report.
Pursuant to 18 U.S.C. §2257(h)(2)(B)(v) and 47 U.S.C. §230(c), the operators reserve the right to remove any user-submitted content they consider indecent, obscene, defamatory, unlawful, or inconsistent with the content guidelines and terms of use.
3. Age of participants
The site is for adults only: readers self-attest to being 18 or older before reading, and authors confirm the same when they register. Every submission is reviewed before publication, and the guidelines’ hard lines forbid any sexual content involving a person under 18, real or fictional, in text as in any other form.
4. Third parties
Any advertising that may appear on Airotica is served by third parties and hosted on their systems. Questions under §2257 about such material should be directed to the party that produced it.
